General Terms and Conditions (GTC)
1. Area of application
These General Terms and Conditions (GTC) apply to all offers and services provided by ALTÍCIMA, represented by Letícia Wopfner, in particular for climbing coaching, climbing courses, workshops, and climbing trips. The service relationship exists between ALTÍCIMA and the clients, hereinafter referred to as ‘participants’.
Details of the services can be found in the respective event descriptions on the ALTÍCIMA website.
By booking a service from ALTÍCIMA, the participants accept these terms and conditions. Deviating terms and conditions of the participants will not be recognised unless ALTÍCIMA agrees to them in writing. Verbal side agreements are not valid.
2. Registration and Conclusion of Contract
The offers on the website and in other online presences of ALTÍCIMA are subject to change and non-binding. The contract is concluded at the initiative of the customer by booking via form, or by contacting ALTÍCIMA via email or telephone, and after written (by email) acceptance (order confirmation) of the offer by ALTÍCIMA. Bookings are binding.
3. Scope of Services
The scope of services is set forth in the description of the respective event. ALTÍCIMA reserves the right to adapt the services to the individual prior knowledge of the participants. ALTÍCIMA does not guarantee that specific training goals will be achieved.
Unless otherwise stated, the scope of services does not include travel costs, accommodation, meals, or admission fees.
Unless otherwise agreed, the fee is to be paid within 5 days of receipt of the invoice. In the event of late payment, ALTÍCIMA is entitled to postpone the service or withdraw from the contract. Payments must be made free of charge for ALTÍCIMA. Additional costs (e.g. for admissions, rental equipment, accommodation) are to be borne by the participants.
4. Payment terms
The total amount is to be transferred to the account specified in the invoice/offer within the period specified in the invoice/offer. The full name of the participant and the name of the workshop, course or climbing trip are to be stated in the reason for payment. Payment is deemed to have been made only when the amount is credited to the account.
5. Conditions of participation
Participation is open to persons who are healthy, able to meet the demands and appropriately equipped. ALTÍCIMA is entitled to exclude participants if they do not meet the requirements. Participation is at your own risk. The influence of drugs and alcohol is prohibited. Rope-free climbing is prohibited. Participants are aware of the risks of climbing and act on their own responsibility. The instructions of the trainer must be followed.
5. Appointment and cancellation
Appointments are arranged individually and are binding. ALTÍCIMA can cancel events in case of force majeure, illness of the trainer or failure to reach the minimum number of participants. In case of cancellation by ALTÍCIMA, payments already made will be refunded or an alternative date will be arranged. Participants can cancel up to a certain point in time before the event begins. In case of cancellation, the following portions of the amount paid will be refunded:

Individual training/individual coaching/workshops:

Up to 30 days before: 90% of the amount paid

14 - 30 days before: 75% of the amount paid

7 - 13 days before: 50% of the amount paid

From 6 days before: 20% of the amount paid

From 72 hours before or no-show: no refund

Multi-day events/trips:

Up to 30 days before: 50% of the amount paid

14 - 30 days before: 25% of the amount paid

From 13 days before: No refund (provided the minimum number of participants is reached)

Course blocks:

Up to 30 days before the start of the first course date: 90% of the amount paid

14 – 29 days before the start of the first course date: 75 % of the amount paid

7 - 14 days before the start of the first course date: 50% of the amount paid

From 72 hours before the start of the first course date: no refund

4.1. Substitute participants
If a substitute participant is provided, a fee of €20 is due for individual training/single coaching sessions/course blocks and workshops, and €50 for multi-day events/trips. Additional cancellation fees for travel and accommodation costs are to be borne by the participants. It is recommended that you contact ALTÍCIMA before cancelling in order to find a joint solution.
6. Insurance
It is recommended that participants take out seminar cancellation insurance. Participants must be adequately insured for rescue and repatriation.
7. Liability
ALTÍCIMA is not liable for damages incurred in connection with the events, unless they are based on gross negligence or intent. Participation is at your own risk. ALTÍCIMA is not liable for damages resulting from violations of the trainer's instructions.
8. Data protection
ALTÍCIMA is committed to confidentiality. Participants' data is processed in accordance with the GDPR. ALTÍCIMA is entitled to use photo and video material for marketing purposes, provided that participants do not object.
9. Copyright
ALTÍCIMA holds the copyright to all materials. The reproduction and distribution of materials is prohibited.
10. Amendments and supplements
Amendments and supplementary agreements must be made in writing. Should individual provisions be invalid, the remaining provisions shall remain valid. Austrian law shall apply. The place of jurisdiction shall be Innsbruck.
